Terms and Conditions

These Terms and Conditions ("Terms") govern your use of the MDflow service available at mdflow.cz ("Service"), operated by DataOps, s.r.o. ("we", "us", "our").

By signing in to the Service you confirm that you have read, understood and accepted these Terms. If you do not accept them, do not use the Service.

1. The Service

MDflow is a web application for writing and organizing markdown documents, with optional one-click public sharing of individual documents.

The Service is currently in active development. Features may change, break or be removed without notice.

2. Your account

You sign in with a Google account. You are responsible for keeping that Google account secure. Any activity carried out through your account is attributed to you.

You must be at least 16 years old to use the Service.

We may suspend or terminate your account at any time, with or without notice, if we believe you are violating these Terms or harming the Service or other users.

3. Your content

You keep all rights to the content you create, store and share through the Service ("Your Content").

By using the Service you grant us a limited, non-exclusive, royalty-free licence to store, process and display Your Content solely to operate the Service for you — for example, to render your markdown, to serve it back to you, and to make it accessible at a public share URL when you choose to share it.

This licence ends when you delete the content or your account.

4. Public sharing — your responsibility

When you enable public sharing on a document, the content becomes accessible to anyone who has the share URL. You are solely responsible for what you publish. Do not share content that:

• infringes anyone else's intellectual property, privacy or other rights
• is unlawful, defamatory, harassing, hateful or threatening
• contains malware, phishing links, or attempts to deceive readers
• violates any applicable law in your jurisdiction or in the Czech Republic

We do not pre-moderate shared documents. We may, at our sole discretion and without notice, disable any share link or delete any content that we believe violates these Terms or the law.

5. Acceptable use

You agree not to:

• use the Service for any unlawful purpose
• attempt to break, overload, probe or reverse-engineer the Service
• circumvent authentication or access content belonging to other users
• use automated means to create accounts, scrape data or generate excessive traffic
• resell or commercially redistribute the Service without our written consent

6. Service availability — no guarantees

The Service is provided "as is" and "as available", without warranties of any kind, express or implied.

We do not guarantee that:

• the Service will be uninterrupted, error-free or available at any particular time
• Your Content will never be lost, corrupted or made temporarily inaccessible
• public share URLs will remain reachable for any specific period
• the Service will be free of bugs, vulnerabilities or data-loss incidents

You are responsible for keeping your own backup copies of any content that matters to you.

7. Limitation of liability

To the maximum extent permitted by Czech and EU law:

• We are not liable for any indirect, incidental, special, consequential, punitive or exemplary damages, including loss of data, loss of revenue, loss of profits, loss of goodwill or business interruption — even if we have been advised of the possibility of such damages.
• We are not liable for any content published by users, including content shared through public-share URLs.
• We are not liable for outages, failures, data loss or security incidents caused by third-party providers we rely on (including but not limited to Supabase, Vercel and Google).
• Our total aggregate liability to you for any and all claims relating to the Service is limited to EUR 0 (zero euro), reflecting the fact that the Service is currently provided free of charge.

Nothing in these Terms limits any liability that cannot be limited under applicable mandatory law.

8. Indemnification

You agree to defend, indemnify and hold harmless DataOps, s.r.o., its members, employees and contractors from any claim, demand, loss or expense (including reasonable legal fees) arising out of Your Content, your use of the Service, or your violation of these Terms or any applicable law.

9. Third-party services

The Service relies on third-party providers (Supabase, Vercel, Google and others). Your use of the Service is also subject to their respective terms and privacy policies. We are not responsible for those providers' acts or omissions.

10. Changes to the Service and to these Terms

We may change, suspend or discontinue any part of the Service at any time, with or without notice.

We may also update these Terms from time to time. The "Last updated" date at the top reflects the latest version. Continued use of the Service after a change constitutes acceptance of the updated Terms. If you do not agree, stop using the Service.

11. Termination

You may stop using the Service at any time. You can request deletion of your account by emailing us at vaclav@wearedataops.cz.

On termination — by you or by us — your access to the Service ends and your content may be deleted in accordance with our Privacy Policy.

12. Governing law and jurisdiction

These Terms are governed by the laws of the Czech Republic, without regard to conflict-of-laws principles.

Any dispute arising out of or in connection with the Service or these Terms shall be subject to the exclusive jurisdiction of the competent courts of the Czech Republic.
